Terms and Conditions of Use for the Media Portal of the Federal Administrative Court
1. Content and purpose
1 These Terms and Conditions of Use regulate access by media representatives accredited with the Federal Administrative Court to the media portal of the Federal Administrative Court, and outline the rights and obligations associated with accreditation.
2 By filing an application for accreditation through the media portal and using the portal, media representatives acknowledge these Terms and Conditions.
2. Legal bases
3. Handling of judgments
1 The judgments made available on the media portal are solely for the official use of accredited media representatives.
2 The blocking period (embargo) indicated on the judgments must be observed; parties to proceedings may not be contacted until the day the blocking period ends.
3 As a rule, judgments published on the media portal are not anonymised, but trade secrets are removed. In certain specialist areas, an anonymised version of a judgment is made available. In both cases, accredited media representatives must follow the applicable professional rules. In particular, they must observe data protection rules and safeguard the privacy of persons involved in legal proceedings.
4. Data storage and use
1 The media portal is hosted by an external provider. The servers used are located in Switzerland and satisfy Swiss data protection and information security requirements.
2 Data entries on the media portal can only be viewed by the external provider and the media service of the Federal Administrative Court.
3 In addition to the usual parameters such as login time and name, the following data is logged (see Article 4 of the Data Protection Ordinance, SR 235.11) when the media portal is used:
- information that an email was successfully sent advising the User that new judgments are available on the portal;
- information that the user has opened a preview of a judgment;
- information that the user has downloaded a judgment.
4 Media representatives are responsible for ensuring that the data they enter into the portal is accurate and up-to-date. Changes must be made promptly.
5 The Federal Administrative Court regularly checks the accuracy of the data entries. If, following an update in the data entries, the accreditation criteria are no longer satisfied, accreditation will be withdrawn. Otherwise, the Federal Administrative Court reserves the right to withdraw accreditation in accordance with Article 5 (sanctions for violations).
5. Sanctions for violations
In the event of a violation of the applicable accreditation rules, the Federal Administrative Court may impose sanctions ranging from a warning to the withdrawal of accreditation.
6. Amendment of Terms and Conditions of Use
The Federal Administrative Court reserves the right to amend these Terms and Conditions of Use as required. Accredited media representatives will be informed in an appropriate manner about any material adjustments. The Federal Administrative Court publishes the most recent version of these Terms and Conditions on the media portal.
